Exemption from Additional User Rates Charges Declaration

Owners of residential properties with an additional dwelling unit may apply for an annual exemption from the additional user rates charges for one of the following reasons:

  • Additional dwelling unit is decommissioned (removed);
  • Additional dwelling unit is not being rented*;
  • Additional dwelling unit is occupied by an immediate family member*; or
  • Additional dwelling unit is not used as a separate residential unit*.

*annual declaration may be required

If an annual declaration is required, you will receive a letter from the City prompting you to apply for the exemption (if eligible). Annual exemptions are effective January 1st regardless of when you meet the exemption criteria in the current or prior year.

Example: You meet the criteria on June 15, 2024 and you apply for an exemption. The reduced charges will take effect for the following calendar year on January 1, 2025, assuming the exemption is approved.

Please note: Additional dwelling units offered as a short-term rental do not qualify for an exemption.

DEFFINITIONS

Additional Dwelling Unit:

means a habitable room consisting of a self-contained unit with a separate entrance for the residential accommodation of only one family and contains a cooking facility but excludes all accommodation for the traveling public.

Immediate Family Member:

means a spouse, child, sibling, step-sibling, parent, or stepparent.

Principal Residence:

means the usual place where an individual makes his or her home.

Please choose one (1) of the following options that reflect the use of the Additional Dwelling Unit. If the below exemptions do not apply, the user rates account will be invoiced for all the dwelling units at the property and this form should not be completed.

CHANGES TO SERVICE CHARGES

If you are submitting a declaration, the following charges will be applied from the date indicated on the letter sent by our office. If there is a change in ownership, the exemption will be effective from the property transfer date, provided the declaration is received by the due date specified in the New Owner Additional Dwelling Unit letter:

  • Water Consumption Charges: The tiers will apply to a single unit only (i.e. Tier 1 will cover 0 - 110 gallons per days instead of 0 - 220 gallons per day).
  • Carts: You can choose to pay an 'Upsize' fee and to receive the 240L Black (garbage) cart. However, the Green (organics) cart will be exchanged for the standard 120L cart. The Blue (recycling) cart will not need to be exchanged unless you have more than one cart.
  • Sewer Unit Rate: You will be charged for a single base rate instead of two.

OWNER ACKNOLEDGEMENTS

I/we certify that the above-noted property: a) contains an additional dwelling unit such as a Secondary Suite or Carriage House, b) the additional dwelling unit has been decommissioned (removed), or c) there was never an additional dwelling unit at this property as long as I/we have owned it.

I/we understand that we will be invoiced according to the information submitted on this form and in accordance with the user rates Bylaws.

I further understand that should the facts under which this declaration is made change so as to disqualify the property from the exemption, I/we have thirty (30) days by which to notify the City of Nanaimo at which time additional charges will be levied. Failure to notify the City of Nanaimo within thirty days may result in a penalty equal to twice the amount that was evaded.
